Majibu ya Zitto Kabwe Kuhusu Madeni yake NSSF n.k.

Yafuatayo ni majibu ya Zitto Kabwe kuhusu baadhi ya maswali yaliyoulizwa katika makala ya 'Waandishi Wanawalinda Wanasiasa Wanaokopa Wananchi?' iliyochapishwa katika blogu ya Udadisi:


Naomba kujibu baadhi ya mambo 

Kuna matamko tofauti unayoyachanganya. Kuna Tamko la wakati wa uzinduzi wa Chama mwezi March mwaka 2015. Hili halikuwa la kutekeleza sheria ya maadili ya viongozi bali kutekeleza masharti ya katiba ya Chama. Maelezo yote mule yalitokana na kipindi cha ubunge wa 2010-2015. Madeni yote mule yanaisha kulingana na Ubunge. Kwa nini? Kwa sababu mikopo ile hulipwa kutokana na kipato cha ubunge na guaranteed na Bunge. Hivyo kila mwezi mbunge hukatwa kulipia deni mpaka muda wa ubunge unapoisha na mkopo huisha. Ni mikopo inayoitwa personal loans

Mwaka 2010-2015 sikukopa NSSF bali nilikopa NMB. Deni lile lilikwisha pamoja na lile la CRDB. 

Madeni unayoona sasa ni madeni ya mwaka 2016 na hizo unazoona ni balance baada ya malipo. Kila mwezi kutoka kwenye mshahara unakatwa kulipia deni na linakuwa limekwisha baada ya miezi 60 (miaka 5).

Mimi ni Mwanachama wa NSSF tangu mwaka 2004 nikiwa mtumishi wa FES. Naweka akiba NSSF kila mwezi kwa miaka 12 sasa. Mimi pamoja na wabunge wengine tunakopa NSSF kwa Sababu 1) kuna fao hilo la mikopo kwa wanachama kwa guarantee ya mwajiri 2) riba yake ni nafuu na 3) ni mkopo salama maana unakatwa moja kwa moja kutoka kwenye kipato cha kila mwezi. 

Pia mwaka 2016 nimetambua madeni niliyorithi kutoka kwenye Chama kwa sababu chama hakina uwezo kulipa. Mikopo mingi niliyochukua ilikuwa ni kulipa madeni ya uchaguzi na nikabakiwa na madeni 2.

Kuhusu Gombe Advisors na Leka Dutigite hakuna mabadiliko yeyote ndio maana huandiki tena upya. Kimsingi mwaka huu ilitakiwa kisheria kuandika ongezeko na pungufu la mali na madeni tu. Haikutakiwa kuandika upya. Kwenye maelezo ya ziada nimeeleza sababu za kuandika upya. Nyaraka za maslahi ya zamani zinakuwa Tume ya Maadili kwenye file langu. Hivyo ukitaka kuelewa tamko la sasa ni lazima usome na tamko la mwaka uliopita kama ulivyofanya. Narudia, hatupaswi kurudia tamko kila mwaka bali unaweka tofauti zilizotokea. 

Nashukuru kwa kuendeleza mijadala hii. Nguvu hii itumie kuwataka viongozi wengine wa umma kuweka matamko yao wazi hasa Rais na Mawaziri. Blogu yako itakuwa imesaidia sana umma. Natumai utaweza kurekebisha andiko lako kwa kuzingatia taarifa hizi ambazo hukuwa nazo. Naamini nitakuwa nimejibu baadhi ya maswali yako na kauli za kihusuda za Rais Magufuli kuhusu wanasiasa kukopa kana kwamba ni dhambi ama yeye hakuwa anakopa alipokuwa mbunge kwenye taasisi hizi.

Matukio matano yamenichochea kuandika makala haya. Kwanza, ni harakati za kulinda ‘Uhuru wa Kujieleza’. Pili, semina ya Kavazi la Nyerere iliyotolewa na Profesa Carlos Nuno Castel-Branco kuhusu‘Deni la Taifa’. Tatu, taarifa ya gazeti la Tanzania Daima kuhusu uwezekano wa chama cha ACT Wazalendo kufilisiwa. Nne, tangazo la Kiongozi wa chama hicho, Zitto Kabwe, kuhusu madeni yake. Tano, mahojiano ya Rais John Magufuli na wahariri yaliyogusia madeni ya wanasiasa.

Kwa wachambuzi wa tasnia ya habari, halikuwa jambo la kushangaza kuona Tanzania Daima ikichapisha katika ukurasa wake wa mbele kwamba ‘Zitto, ACT-Wazalendo Hatarini Kufilisiwa.’ Gazeti hilo linajulikana kama ‘kinywa’ cha chama cha Demokrasia na Maendeleo (CHADEMA) ambacho kilimvua uwanachama Zitto. Hivyo, siyo jambo la ajabu kuona likipata ujasiri wa kujaribu kuanika habari za Naibu Katibu Mkuu huyo wa zamani wa chama hicho. Ndiyo maana mwana-ACT, Dotto Rangimoto, amehoji kwenye Jamii Forums kama ‘Mbowe anasaka "Kiki" kwa jina la Zitto?’

Siku hiyo hiyo ya tarehe 27 Desemba 2016, Zitto alitoa tamko lililosajiliwa na "Wakili na Kamishna wa Viapo", Emmanuel Mvula. Tamko hilo lililowekwa katika vyanzo mbalimbali mtandaoni tarehe 30 Desemba 2016 linatoa ufafanuzi kuhusu deni ambalo gazeti la Tanzania Daima lilikuwa linajaribu kulianika na kulijengea hoja kwa kutumia taarifa ya madai ya madeni inayomhusisha mdai Soraya Souleymane. Hilo nalo halishangazi kwani baada ya kuwasisitizia watimize ahadi yao ya kutoa taarifa za gharama za uchaguzi mkuu wa mwaka 2015, ACT-Wazalendo walizitoa mtandaoni tarehe 15-16 Februari 2016 ambapo jina la mdai huyona wengineo yaliwekwa wazi.

Hivyo, kitu kilichotuacha na butwaa baadhi yetu ni taarifa hii katika tamko hilo la mwaka huu: “NINA DENI LA TZS 191,060,094. HILI DENI LINATOKANA NA MKOPO KUTOKA NSSF.” Kwa nini linashangaza? Mosi, ni kwa sababu tamko hilo halituambii ni lini fedha hizo zilikopwa. Pili, ni kwa sababu katika tamko lake la aina hiyo la tarehe 29 Machi 2015 deni hilo halikuorodheshwa. Tatu, kutokuwepo kwa taarifa hizo kunatufanya tusijue kama zilikopwa wakati Zitto alipokuwa Mwenyekiti wa Kamati ya Bunge ya Hesabu za Serikali (PAC) ambayo ‘inaisimamia’ NSSF.

Utata huo umepelekea wadadisi wa mambo tuikumbuke hoja hii ya Rais Magufuli wakati wa mahojiano na wahariri wa vyombo vya habari tarehe 4 Novemba 2016:


Wadau wa 'hashtag' ya #UhuruWaKujieleza tunapaswa kuifanyia kazi changamoto hiyo. Bila ajizi Rais amesisitiza kwamba waandishi tunawalinda wanasiasa waliokopa katika taasisi zetu za umma. Bahati nzuri mwanasiasa mmojawapo amekuwa muwazi kwa kiasi chake kuhusu madeni yake ya NSSF na haya mengine: “NINA DENI LA TZ 176,315,106.21. HILI NI DENI LINALOTOKANA NA MKOPO KATIKA BANK YA CRDB.” Je, tutegemee tu utashi na uadilifu wa wanasiasa au turasimishe uwazi na uwajibikaji wao?

Changamoto iliyobaki kwetu ni kuwabana wanasiasa wengine nao wawe wakweli na wawazi au, kama alivyosema Rais, waandishi tuwachambue na kuwaanika hadharani bila kupepesa macho. Pia kwa ambao wamejitahidi kuwa wawazi tusiishie kuwapongeza tu. Tunatakiwa pia kuweka mapenzi na ushabiki wetu kwao pembeni na kuwauliza maswali magumu kuhusu namna walivyopata mikopo na jinsi ambavyo watalipa madeni ili Watanzania wote tufaidike.
Zitto ameonesha mfano. Kaonesha na ujasiri wa kujibu maswali yaliyoibuka kuhusu tamko lake ambapo amesisitiza kuwa anaamini “kwamba uwazi ni moja ya silaha madhubuti ya kupambana na ufisadi”. Hivyo, kawasilisha “muswada bungeni kutaka uwazi huu liwe sharti la sheria za nchi yetu.” Kupitia tamko lake rasmi pia:


 Sasa ni jukumu la waandishi kumuuliza Zitto naye atoe ufafanuzi kuhusu baadhi ya zinazoonekana kama tofauti kati ya taarifa yake ya mwaka jana na ya mwaka huu. Kwa mfano, taarifa ya mwaka huu haionekani ikiyataja makampuni ya Gombe Advisors Limited na Kigoma Development Initiatives (KDI) Limited ambayo mwaka jana aliyaorodhesha. Je, ameacha kumiliki hisa katika makampuni hayo ambayo amekuwa anasisitiza kwamba siyo ya kupata faida? Kama na yenyewe yalikopa, je, madeni hayo yameshalipwa? Na kama umiliki wake umebadilika, nani ni mmiliki wake? Maswali kama haya ni muhimu hasa ukizingatia kwamba tarehe 10 Desemba 2016 aliyekuwa Mkurugenzi wa Kampuni ya Leka Dutigite ambayo ilikuwa ina uhusiano wa kihisa na GombeAdvisors, Habib Mchange, alitoa taarifa kwa umma kuhusu ‘KUJIVUA UANACHAMA WA ACT WAZALENDO NA KUTOSHIRIKI SIASA’ ili apate “muda mwingi zaidi kufanya na kusimamia shughuli” zake “za kijasiriamali.”

Jambo jingine linalostahili kuhakikiwa na waandishi wa kiuchunguzi ni taarifa ya malipo ya madeni. Katika tamko la mwaka huu Zitto anatuambia: “NIMEPUNGUZA MADENI NILIYOKUWA NADAIWA TOKA TAMKO LA AWALI LA MWAKA 2015 NILILOTOA TAARIFA YA DENI KIASI CHA TSH 560,000,000/=”. Ukilirejea tamko la mwaka jana unakuta deni la NMB ambalo mwaka huu halipo, ikiashiria kwamba ameshalilipa lote. Ama? Pia tunakuta taarifa hii: “Nina mkopo wa Tshs. 24,624,046.88 katika Benki ya CRDB. Huu ni bakaa la mkopo wa Tsh. 200,000,000 niliouchukua mwaka 2010 na 2011.” Lakini mwaka huu tamko linasema ana deni la TZ 176,315,106.21 la CRDB. Je, hili ni deni la bakaa ile ile? Au ni mkopo mwingine? 
Deni la Taifa, kama alivyosisitiza Profesa Castel-Branco katika semina yetu kavazini, huchangiwa pia na mabenki ‘kukopesha madeni’. Huu ‘ufedhazishaji’ pia hupelekea madeni binafsi kugeuzwa kuwa madeni ya umma. Kwa nini? Kwa sababu taasisi za umma zilizokopesha watu binafsi zinapofilisika mzigo hubebwa na wananchi wote.

Badala ya kulindana tuanze kuanika madeni ya umma na kusisitiza wahusika walipe.

La sivyo tutakuwa hatuutendei haki #UhuruWaKujieleza.

Jamii Forums and Corporate Corruption on Trial

The future of Jamii Forums (JF) is at stake. So is the fight against grand corruption. Like conjoined twins, the two are intertwined.

A study that was "prepared with support from the Tanzanian Police Force (TPF)" is a testament of the powerful role of JF. It states: "Jamii Forum... is one of the most respected sites that facilitate open (and anonymous) reporting." One wonders what has happened to this 'respect' after the arrest of the co-founder of JF that has galvanized a trending hashtag movement to #FreeMaxenceMelo.
JF has been at the forefront of unearthing virtually all cases of grand corruption in Tanzania. It is thus an ally of anyone who is fighting against corruption that has increasingly been corporatized in the country hence our use of the term 'corporate corruption'

Whistleblowers must be protected especially in a regime that is ostensibly committed to fight corruption. As they say, even if a witch tells you there is a venomous snake on the way what matters is for you look if the snake is indeed out there. If a whistleblower alleges on JF that someone was involved in, among other things, a container scandal at the Tanzania Ports Authority (TPA) or there is  theft at the CRDB bank, who should be the focus of your attention?

For a regime that is so keen to clean the mess at TPA as we have seen in the dramatic case of two impromptu visits from the Prime Minister, surely whistleblowing about how oil is smuggled there is useful. It is even more tantalizing to look at the alleged 'corporate connection' between big oil companies and the smuggling. Or the allegations that one of the leading oil company is involved in a gas deal akin to the one that the President has blasted when he met with the own of Dangote Cement. Does the strong state apparatuses need the identity of the whistleblowers to confirm such allegations? Or are there 'corporate interests' that want the whistleblowers muted?

If indeed companies and powerful corporate individuals are behind this subtle attempt at silencing whistleblowers, then our champions in the war against corruption might be taken for ride. They might be undermining their noble cause by sidelining an ally while embracing the very corrupt entity they are supposed to combat. Such would be the glaring consequence of using public means for protecting private gains. Ironically, the legal regime is double-edged because now any interested party can use the law and have the state and police demand information about whistleblowers.
Since the President is doing a commendable job of revamping Air Tanzania Company Limited (ATCL), let us revisit a case of how the JF platform has/had been instrumental in whistleblowing about its management. In 2015 a special report noted that one whistleblower alleged -- on JF and elsewhere -- that the involvement of one of the foreign companies "prompted the Government of Tanzania and ATCL’s board of directors to shelve a modest 5-year plan to rehabilitate the company in favor of a more ambitious plan to take the company to 'new heights.'" As a result, the performance of ATCl continued to "nosedive". Could this be the reasons why a new ATCL board has been constituted? If that is the case, why would it have been important to know the actual name of the presumed "ATCL insider" who wrote under the pen name Byase Luteke?

Sages had whistleblowers in their mind when they said "mjumbe hauawi" ('you don't kill the messenger'). Just act on the message. Is there a venomous snake on our pathway out of corruption?

I had a long week. At last I could rest on a long weekend. But, alas, I was made wide awake by the beautiful drums and commentaries from the Uhuru Stadium, in Dar es Salaam, thanks to my better half who had switched on the TV earlier. Oh, yes, we were commemorating 55 years of Tanganyika’s independence, the date we became captains of our own ship. In my mind, an image of Mwalimu Nyerere, who was only a year older than my current age- wearing a dazzling smile while holding the ‘Complete Independence’ placard, became vivid. This placard is visibly attractive especially when you pass along Bamaga- Shekilango road.

There was a true, genuine, and unreserved expression of satisfaction in his smile - we were INDEPENDENT! It is this image that made me realize how important this day was - December 9, 1961.  It was the day we were released from the shackles of colonialism, an inhuman form of suppression exhibited in many forms including physical torture. The day we were supposedly freed from mental slavery and, most importantly, the day we laid a foundation for our nation. To our Father and Almighty God, I pray that you protect this nation under your mighty wings. Amen.

My appreciation of Uhuru Day is deeply engrained in my soul. I have known no other country apart from Tanzania that allows its subjects to plan and achieve their goals in a wide array of issue, regardless the hiccups that we normally face. I don’t ask for more than my peaceful and united Tanzania. Viva Tanzania!

Then you must be wondering what has pushed me to write this piece? As you might guess, it’s just nuisance …….  oh yes, in defense of the beauty and sanctity of the military parade.

Let me start with a stupid question: If all roofing materials are intended to cover our houses from rain, why don’t we consistently use thatched grass, which, after all, are cheap? Instead, we tend to go for expensive roofing materials for their beauty. Beauty has a place in everything.  Similarly, there is no question about the beauty of the military parade! Thousands of Tanzanians thronged the Uhuru stadium to see just that. It is irresistible to miss the 'muscular show' from the 'men soldiers' in the  Tanzania People's Defence Force (TPDF) and Field Force Unit (FFU), let alone the ‘slomo’ of our 'women soldiers' who do it meticulously but with a 'feminine swagger'. If they didn’t know it, they should know now that it is these foot drills and the ‘show’ of our Special Force Unit [Commandos] that pool the crowd at the Uhuru stadium and probably attract many youth to join the military.

We also know that such 'peak' performance are preceded by rigorous practice and not just  rehearsal. In the military, probably unlike anywhere else, a lot is going through to perfect performance. We may think that all soldiers are capable of mastering the foot drills at equal footing. However, there are slow learners who, at times, must be coerced to cope.

MY PROBLEM, then, is on the performance day, especially when the President is inspecting the parade. presidential guards dressed in civilian suits have been seen walking along with the president without considering the proper dressing and the sanctity of the paradeAt one point on December 9, 2016 one of the secret agents who is a presidential guard was seen checking on and adjusting his neck tie while at another occasion, the secret agent is completely wrong-footed with the rest of the team accompanying the Guest of Honour! These incidents crowd the beauty of this important and historic ceremony.

It might not be proper to question the mandate and role of secret agents, but, why is it different when the Tanzanian Head of State visits other countries? For example, when President Magufuli visited Kenya, we did not see such secret agents around and the dressing of the team accompanying the Guest of Honour was proper.

In international politics, probably the US president and the Prime Minister of Israel are regarded as risk targets to terrorists than most of the Heads of States in the world. But you will be surprised that when President Obama visited Tanzania during the reign of former President Jakaya Kikwete, he inspected the parade without being crowded by presidential guards and secret agents !

Literature on military parades indicate that all weapons are inspected before the parade and they are not supposed to be loaded. And there are special units of the police force, military and secret agents who are positioned to protect the President or any other Guest of Honour, including foreign Heads of States during the military parade. We understand the security of Heads of States must be heightened, and I would love our corruption-fighting hero, President Magufuli to be guarded heavily, everywhere. I will even tolerate incidences like removing hands of ‘citizens’ who maintains a lengthy shake of hands with the president, and preventing others from coming near the President [we have seen and noted that in several occasions]. But the sanctity of the military parade with its proper dressing of the team accompanying the President as the Guest of Honour ought to be observed.
